Terms of Service

These terms are the agreement between you and Fradiation Games about your use of Fradiation Games. Please read them.

Agreement

By using Fradiation Games (the website at https://www.fradiation.games, the game domain containment.cloud, and everything on them, together "the site"), you agree to these terms and to our Privacy Policy. If you don't agree, don't use the site.

In these terms, "we" and "us" mean Fradiation Games. "You" means the person using the site. A "developer" is someone who has been given access to upload games.

You can browse and play without an account. Some parts of these terms only matter once you have an account or upload a game, and they say so.

Who can use the site

You must be at least 13 to have an account. If your country sets a higher age for agreeing to the use of your personal data (in parts of the European Union it can be up to 16), you must be at least that age, or have a parent or guardian's permission. If you are under the age of majority where you live, ask a parent or guardian to read these terms with you.

You can't use the site if the law where you live forbids it, or if we have removed your account and told you not to come back.

We don't check your age. By creating an account you tell us that you meet these requirements.

Accounts and badges

You sign in with Discord or GitHub. On the site, your account is called a badge. Your use of Discord or GitHub is covered by their own terms, not ours.

You are responsible for your account and for what happens through it, including anything done with an API token you create or by a coding agent you allow to use your account. Keep your Discord or GitHub account and your tokens secure. If you think someone else is using your account, email us at privacy@fradiation.games.

One person, one account. Don't create extra accounts to avoid a ban, to vote more than once in containment, to earn rads, or to make ratings and comments look like they come from more people than they do.

Your handle and display name are public. You don't own a handle. We can change, remove or reclaim a handle, display name, bio or image that is abusive, impersonates someone, or breaks these terms.

You can ask us to delete your account at any time by emailing privacy@fradiation.games. The Privacy Policy explains what happens to your data.

Developer access is by invite. We can remove it at any time.

Playing games

Most games on the site are made by independent developers, not by us. We don't write, test or check every game, and having a game on the site doesn't mean we endorse it. The rest of this section applies to every game on the site, including games we publish ourselves.

Some games contain mature content, such as violence, strong language or disturbing themes. The site doesn't rate games by age and doesn't restrict access by age. If you play, you decide what is right for you. If you are a parent or guardian, you decide what is right for a child in your care. Some games use flashing lights or effects that can affect people with photosensitive conditions.

Games run in a sandbox on their own web address, separate from the site. That limits what a game can do, but no sandbox is perfect. A game can save data in your browser under its own address, can contact servers run by its developer, and can open links or windows to other sites. What a game does with data it collects itself is the developer's responsibility, not ours. See the Privacy Policy for details.

Games and the site are provided as they are. A game can be buggy, change, or be removed at any time. Scores, saves, rads and mutations can be lost or reset.

If a game breaks these terms or seems unsafe, report it (see "Reports and takedowns").

Your content

"Your content" means what you post or send through the site: comments, replies, ratings, reports, playtest feedback, your display name, bio and anything else you submit.

You keep ownership of your content. To run the site, you give us a non-exclusive, worldwide, royalty-free license to store, host, copy, show, and format your content, and to share it with the people who are meant to see it. That includes showing your comment under a game and on your profile, showing your profile in preview images, and passing your playtest feedback to the game's developer. We can let our hosting providers do these things on our behalf. The license lasts as long as your content is on the site, and a short time afterwards while it clears from caches and backups. It also covers copies that other people have quoted or replied to in the normal course of using the site.

You confirm that you have the right to post your content and that it doesn't break the law, someone else's rights or the community rules below.

If you give feedback on a game, the developer can use it to improve the game. They don't owe you payment or credit for it.

You can delete your own comments. We can remove any content that breaks these terms or that we think is harmful, and we don't have to host anything.

Community rules

Don't do any of these things on the site or in a game on the site:

  • Harass, threaten or bully anyone, or share someone's private information.
  • Post hateful content, or content that attacks people for who they are.
  • Post spam, scams, or repeated self-promotion that swamps a conversation.
  • Cheat. That includes using scripts, bots or exploits to farm rads, inflate plays or ratings, manipulate leaderboards or containment votes, or forge scores or unlocks.
  • Pretend to be someone else, including another player, a developer or us.
  • Post illegal content, or content that sexualizes children. We report that to the authorities.
  • Spread malware, phishing links or anything designed to harm a device or steal an account.
  • Attack the site, probe it for weaknesses without our permission, overload it, or try to reach data that isn't yours.

If you break the rules, we can remove content, reset or adjust your rads and mutations, limit what you can do, or suspend or delete your account. We will use judgment. We are not obliged to give a warning first.

Developer terms

These apply if you upload a game.

Access. Developer access is by invite. Uploading, playtests and the developer dashboard are available only while you have it. We can remove it at any time.

You own your game. Nothing in these terms transfers ownership of your game to us.

License to us. While your game is on the site, you give us a non-exclusive, worldwide, royalty-free license to host, store, copy, serve, display and promote your game, including its files, title, cover image, description, patch notes and screenshots. We can use them on the site, in preview images and links, and where we promote the site. We can let our hosting providers do these things on our behalf. The license ends when the game is removed, apart from a short period while copies clear from caches and backups. It doesn't let us sell your game.

You must have the rights. You must own, or have permission to use, everything in your game: code, art, music, sound, fonts, characters, libraries and engines. Don't upload anything that infringes someone else's copyright, trademark or other rights.

Tell the truth about AI. You must accurately say whether your game is handmade, AI-assisted or AI-generated, and which parts (code, art, audio, text) used AI. Wrong or missing disclosure is a reason for a report and for removal.

What your game must not do. Your game must not:

  • contain malware, phishing or a crypto miner;
  • track players without telling them;
  • collect personal data without your own privacy notice, or from children in ways the law doesn't allow;
  • try to escape its sandbox, or to reach the site, other games or other players' data;
  • forge scores or unlocks, or misuse the SDK to get around the rules;
  • contain secrets such as API keys, since everyone who plays can read what's in a build;
  • break the community rules above.

Your own services. Your game can call your own servers. If it does, you're responsible for those services and for the data you collect. You must comply with the law, including children's privacy laws if children may play your game. We are not responsible for them.

Playtest data. If you run a playtest, you receive information about your testers: device details, play time, timeline events, errors, feedback and, for guests, an optional name and a random ID. Use it only to test and improve that game. Keep it secure. Don't sell it, publish it, share it beyond people working on the game, or combine it with other data to identify testers. Delete it when a tester asks, or when you don't need it, or ask us to. Don't put personal data in the events your game sends.

Builds and retention. We don't keep every build forever. Builds can be removed and their files deleted under the retention rules on the builds page. Those rules can change. Keep your own copy of anything you need.

Containment. When you submit a game, it goes into containment. Players who have played it vote to release or bury it, and the result decides whether it is released to the public. A buried game stays on the site, marked as buried, and can come back for another round under the rules in the containment docs. Administrators can release or bury a game early, and can remove any game.

Removal. We can remove or hide a game, delete its files, or take back developer access, at any time, including for breaking these terms, for safety, or for legal reasons. You can ask us to take down your game by emailing privacy@fradiation.games.

No pay. We don't pay developers, and using the site doesn't create an employment, partnership or revenue-sharing relationship between us.

Rads, mutations and badges

Rads, mutations, exposure levels, badges and leaderboard places are part of the game we've built around the site. They have no monetary value. They aren't your property, you can't sell, trade or transfer them, and they don't entitle you to anything.

We can change how they are earned, adjust them, remove them or reset them. We will do that to fix bugs, to undo cheating, or when the rules change. They may be lost if your account is deleted or if the site changes or closes. Exposure level can affect things like how much a vote counts. We can change that too.

Developers don't earn rads from their own games.

Reports and takedowns

Reporting a game. Use the report button on the game's page. You need an account to use it. Choose the reason and add a note if it helps. Administrators read reports, and we take games down when they need to come down.

Reporting anything else. For a comment, a profile, or anything else that breaks these terms or that you have a legal complaint about, email privacy@fradiation.games with a link to the content and what's wrong with it.

Copyright. If you believe something on the site infringes your copyright, email privacy@fradiation.games with:

  1. a description of the copyrighted work you say has been infringed;
  2. the web address of the material on the site, and enough detail for us to find it;
  3. your name, postal address, email address and telephone number;
  4. a statement that you believe in good faith that the use isn't authorized by the copyright owner, its agent or the law;
  5. a statement that the information in your notice is accurate, and, under penalty of perjury, that you are the owner or authorized to act for the owner;
  6. your physical or electronic signature.

We may remove or disable the material and pass your notice to the person who posted it. If you believe material was removed by mistake, you can send us a counter-notice with the details the law requires, and we will handle it as the law requires. In appropriate cases, we end the accounts of people who repeatedly infringe copyright.

We may remove content or a game without a report if we think it breaks these terms or the law.

Termination

You can stop using the site at any time, and you can ask us to delete your account.

We can suspend or end your account or your access to any part of the site, remove your content, or take down your games, if you break these terms, if the law requires it, if you put the site or other people at risk, or if we stop offering the site. When we can, we'll tell you why. You can reply to us by email if you think we made a mistake.

When your account ends, your right to use it ends. The licenses you gave us for content already shared with others, and the parts of these terms that by their nature should continue (such as the disclaimers, the limit of liability and the developer's responsibility for their games), continue.

We can change or shut down the site, or part of it, at any time. If we can, we'll give notice first.

Disclaimers

The site, and all games and content on it, are provided "as is" and "as available". To the fullest extent the law allows, we make no promises or warranties of any kind, express or implied. That includes promises that the site or a game will be available, uninterrupted, error-free or secure, that it will be fit for a particular purpose, that it won't infringe anyone's rights, or that scores, saves, rads or other data will be kept.

We aren't responsible for games or content made by others, for links to other sites, or for what others do with anything you share. We don't check or approve everything posted.

Nothing in these terms takes away rights you have under consumer protection law that can't be waived.

Limit of liability

To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost data or lost goodwill, from your use of the site or a game, even if we were told this could happen.

To the fullest extent the law allows, our total liability to you for all claims about the site is limited to the greater of what you have paid us in the past 12 months and US$100. Because the site is free, that is US$100 unless you have paid us something.

Nothing in these terms limits our liability for anything that can't be limited by law, such as fraud, or death or personal injury caused by our negligence.

Indemnity for developers

If you are a developer, you agree to defend us and to cover costs and losses that come from claims made by others about your game, your builds, your content or your services, or from your breaking these terms. That includes claims that they infringe someone's rights, harm someone, or break the law. We will tell you about the claim promptly, and we may take part in dealing with it.

Changes to these terms

We may change these terms. We will post the new version on this page with a new effective date. If a change is significant, we'll put a notice on the site before it takes effect. If you keep using the site after a change takes effect, you accept the new terms. If you don't accept them, stop using the site and ask us to delete your account.

General

The site's design, code, brand and the content we create belong to us or to the people who license them to us. These terms don't give you any right to use them, other than to use the site as intended.

If part of these terms can't be enforced, the rest still applies. If we don't enforce a term right away, we haven't given up the right to enforce it later. These terms and the Privacy Policy are the whole agreement between you and us about the site. You can't transfer your account or your rights under these terms to anyone else. We can transfer ours, for example if the site is passed to a new operator.
